are published the terms and conditions ("Terms") under which you
may submit a product/service/technology startup entry ("Entry") for
consideration in the MobileMonday Global Peer Awards
2007 ("Awards") at the nomination web site of the Awards
(the "Web Site").
Please read this page carefully. The Terms govern your chapter's Entry. By
using the Web Site, you are indicating your agreement to be bound by the Terms.
1 - PURPOSE OF THE GLOBAL PEER AWARDS 2007
The scope of the Awards is
(a) rewarding and recognizing innovation and excellence in the
global mobile industry;
(b) to give light to those companies, individual developers
and/or innovative products/services/technology that bring new ideas to the
mobile industry;
(c) to give international publicity to the global mobile sector
and its innovations.
2 - ENTRANTS
An Entrant eligible to the Awards is:
(a) A startup company: Smaller, lesser-known, unestablished
company.
(b) A company willing to show off mobile-related innovations (products,services, technologies,
concepts).
(c) A company willing to travel to the event at its own cost.
(d) The legal owner of the Entry, or the person/company holding the Entry's
economical rights to business use ("Owner")
The following Entrants are NOT eligible:
(a) Members of the Awards Evaluation Committee and their relatives to the
second degree.
(b) Awards Organizers, their companies and their employees.
Entrants are responsible for their own information and all the consequences of
submitting an Entry.
3 - CATEGORIES
Among all the finalists at least 3 Awards will be given:
(a) Expert Jury Award;
(b) MobileMonday Community Award (MobileMonday
organizers from each chapter on site will choose their winner);
(c) Audience Award (all participants will vote for their winner via SMS).
4 - ENTRIES ELIGIBLE FOR THE AWARDS
An Entry, in the frame of these Awards, is a product or a service that complies
with the following criteria:
(the list is not exhaustive and is given for example only)
(a) to have a link with the mobile industry
(b) to be a completely new product/service/technology or to bring a concrete
improvement to existing products/services/technology
(c) to have a business model that could be developed on the global market
(d) to be in final form
A submitted Entry may NOT:
(e) be copyrighted or use copyrighted material, unless Entrant owns the
copyright or has the written permission of the copyright Owner to submit it
(f) contain material that reveals trade secrets, unless Entrant owns the trade
secrets or has the written permission of the Owner to reveal them
(g) contain material that infringes any intellectual property rights of others
or their privacy or publicity rights
(h) contain material that is obscene, defamatory, threatening, harassing,
abusive, hateful, or embarrassing to any person or entity
(i) contain material that constitutes a sexually-explicit
image or statement
(l) contain material that impersonates another person
The Entrant warrants to the Awards Organizers that all information,
communications, software, photos, text, video, graphics, music, sounds, images
and other material submitted by Entrant for consideration for the Awards are
solely owned by Entrant or are provided with the express authority of the
applicable owner(s) and do not infringe upon any other individual or
organizational rights (including, without limitation, intellectual property
rights).
The Awards Organizers have an exclusive right to decide which Entries are
eligible for the Awards. Uneligible Entries will be
rejected.
5 - ENTRY AND SUBMISSION DEADLINE
All Entries must be submitted as described in the Registration Process
paragraph by 23:59 on the 31st of January 2007.
There will
be no deadline extensions given and no exceptions.
6 - REGISTRATION PROCESS
(a) Each Entry linked to a local chapter must be registered to the competition
on momo.mobilemonday.it/award,
(b) As a result of the registration, each Entry gets the Awards Registration
Number - ARN.
(c) The
local MobileMonday chapter chooses from all Entries
the one Entry that represents the chapter in Awards as a Finalist.
7 - EVALUATION PROCESS
Each local MobileMonday chapter is free to apply any methodology in selecting its candidate from the Entries. The chosen candidate, max. one from each chapter, will travel to Barcelona as a representative of its home chapter. These candidates from diverse chapters will compete against each others as finalists in the Global Peer Awards competition.
The Finalist Entries provided later by the local chapters to the
Awards are subject to a preliminary review by Awards Organizers prior to
the competition event. This review is to ensure that:
(a) The Entry is complete. Incomplete or late Entries will be disqualified.
(b) The Entry meets all eligibility criteria. Awards Organizers reserve the
right to disqualify an Entry if Entry does not meet the necessary
qualifications.
The winners are voted
in the Global Peer Awards event in Barcelona
on the 12th February 2007.
The winner
Entries are the first in the ranking in three categories:
(a) Expert Jury;
(b) MobileMonday Community;
(c) Audience on the site.
The Awards
results are final and incontestable. The Entrants waive any recourse against
the Awards Organizers, its employees, the Jury or its members by reason of any
decision taken by the Jury.
8 - AWARDS BENEFITS
The Winners will receive the following benefits:
(a) Worldwide recognition, media attention and prestige.
(b) All winners will receive a separate, special "winners" icon,
which can be used in own promotion activities.
(c) All winners will be invited to participate in the Innovation Pad activities
at the MobileMonday Global Summit in Helsinki in May.
All Entries submitted by local chapters will receive the following benefits:
(a) A finalist status at the MobileMonday Global Peer
Awards 2007
(b) Worldwide recognition, media attention and
prestige.
(c) Promotion on the MobileMonday global website.
(d) Promotion at the event in Barcelona
(e) The opportunity to present their innovations live,
in front of the audience and jury.
(f) Valuable feedback from the expert jury.
(g) An official MobileMonday Global Peer Awards 2007
Finalist digital icon, which can be used in own promotion activities.
All travelling and accommodation expenses are in
charge of the startup entries.
9 - GRANTS OF LICENCE
(a) Use of Entries and Entry Material: General Use
By submitting an Entry for Awards consideration, Entrant automatically grants
to the Awards Organizers a royalty-free, irrevocable, worldwide,
non-transferable, non-exclusive right and license to use and display such
Entry, which shall include any Web Site Entry and any Entry Material, in whole
or part for a period of five (5) years from the date of submission (the
"License Period"). Awards Organizers will make a reasonable attempt
to limit duplication of the Entry Material to that number of copies necessary
for the limited purposes of reviewing Entries for assignment to Awards and
judging Entries. Notwithstanding the license granted during the License Period,
Awards Organizers will remain the owner of the Entry and any information
supplied on the Online Entry Form or document submitted.
(b) Use of Entries and Entry Material: Finalist and Winning Entries
If an Entry is selected as a Awards finalist, Entrant automatically grants
Awards Organizers a royalty-free, perpetual, irrevocable, worldwide,
non-transferable, non-exclusive right and license to promote, publish or
display the Entry, in printed and electronic formats, which include but are not
limited to, trade publications, press releases, electronic posting to the Web
Site, the Awards Organizers web site, electronic hyperlinks to the web site of
the Entrant, and any display format selected by Awards Organizers during the
Awards ceremony. Entrants that submit winning Entries automatically grant
Awards Organizers a royalty-free, perpetual, irrevocable, worldwide,
non-transferable, non-exclusive right and license to promote, publish or
display the Entry, in printed and electronic formats, which include, but are
not limited to, trade publications, press releases, electronic posting to the
Web Site, the Awards Organizers web site, and electronic hyperlinks to the web
site of the Entrant.
All intellectual property rights will remain assets of the Owner of the Entry.
Submitted Entries rights protection is the responsibility of each Entrants using the copyright notice or patent deposit to the
local or international patent offices.
10 - DISCLAIMER
Awards Organizers have no obligation to screen an Entry or Entry Material in
advance, and are not responsible for monitoring Entries, to prevent violation
of intellectual property ownership rights, or violations of any law, rule or
regulation. If Awards Organizers are notified of submissions or materials that
allegedly do not conform to the Terms, Awards Organizers may investigate the
allegation and determine in good faith and in its sole discretion whether to
eliminate an Entry from consideration for any Awards Category. Awards
Organizers have no liability or responsibility to Entrants or other users of
the Web Site or Entry Material for performance or non-performance of such
activities. The web site, online entry form and documents submission method are
provided on an "as is" basis without any warranties of any kind. To
the fullest extent permitted by applicable law, Awards Organizers disclaim all
warranties, express or implied, including, but not limited to, implied
warranties of merchantability, fitness for a particular purpose and
non-infringement. Without limiting the foregoing, Awards Organizers
specifically disclaim any warranty (a) that the web site, online entry form or
documents submission method will be uninterrupted or error-free, (b) that
defects will be corrected, (c) that there are no viruses or other harmful
components that exist on the web site, online entry form or pdf
entry form (d) that the security methods employed to protect the disclosure of
information will be sufficient, and (e) regarding correctness, accuracy, or
reliability. If Entrant's use of the web site, online entry form or documents
submission method results in the need for servicing or replacement of Entrant's
or another's equipment or data, Awards Organizers are not responsible for those
costs.
11 - LIMITATION OF LIABILITY AND REMEDIES Entrant and any party that accesses
the web site, online entry form or documents submission method
(individually the "Visitor") agree that neither Awards Organizers nor
its third party content or service providers will be liable to Visitor for any
loss or damages, either actual or consequential, arising out of or relating to
these terms, Visitor's use or inability to use the web site, Visitor's
submission of an entry to the web site, or to Visitor's reliance upon
information obtained from or through the web site, online entry form or
documents submission method. In particular, neither Awards Organizers nor its
third party content or service providers will have liability for any
consequential, indirect, punitive, special or incidental damages, whether
foreseeable or unforeseeable (including, but not limited to, claims for
defamation, errors, loss of data, or interruption in availability of data),
arising out of or relating to these terms of use, Visitor's use or inability to
use the web site, online entry form or documents submission method, or to
Visitor's reliance upon information obtained from or through the web site,
whether based in contract, tort, statutory or other law, except only in the
case of death or personal injury where and only to the extent that applicable
law requires such liability.
12 - INDEMNIFICATION
Entrant hereby indemnifies, saves and holds Awards Organizers, its successors
and assigns, harmless from any and all liability, claims, demands, loss and
damage (including legal fees and court costs) arising out of or connected with
any claim or actions by a third party which is inconsistent with any of the
above warranties and representations made by Entrant and shall reimburse Awards
Organizers for any loss, costs, expense, or damage to which said indemnity
applies. Awards Organizers shall give Entrant prompt written notice of any
claim or actions covered by this indemnity, and Entrant shall have the right,
at its own expense, to participate in any such action.
13 - HEADINGS
The headings of the Sections hereof are for convenience of reference only and
shall not modify, define, or limit any of the terms or provisions hereof.
14 - GENERAL
Awards Organizers are MobileMonday Oy (PO Box
1361 - 01001 Helsinki
- Finland), Mobile Monday
Italy, Mobile Monday Barcelona, Mobile Monday London and Mobile Monday New York.
Awards Organizers make no claims that the Web Site or documents submission
method may be lawfully viewed or downloaded outside of Finland. Access
to the Web Site or documents submission method may not be legal by certain
persons or in certain countries. If Visitor accesses the Web Site from outside
of Finland,
Visitor does so at his or her own risk and is responsible for compliance with
the laws of his or her jurisdiction. The Terms are governed by the internal
substantive laws of Finland
without respect to its conflict of laws principles. Jurisdiction of any claims
arising under the Terms will lie exclusively with the state or federal courts
of Helsinki, Finland, and Visitor consents to
the exclusive personal jurisdiction of such courts if there is a dispute
between Visitor and Awards Organizers. Visitor may not institute any action in
any form arising out of use of the Web Site or documents submission method or
the Terms more than three (3) months after the cause of action arises. If any
of the Terms is found to be invalid by any court having competent jurisdiction,
that invalidity will not affect the validity of the remaining Terms, which will
remain in full force and effect. No waiver of any Term will be deemed a further
or continuing waiver of such provision or any other provision. The Terms
constitute the entire agreement between Visitor and Awards Organizers with
respect to the use of Web Site. No
changes to the Terms may be made except by a revised posting by Awards
Organizers on this page, and no waiver of any Term will be effective unless it
is in writing and signed by a representative of Awards Organizers.
